New laws go into effect October 1, 2005:
· Changes mandatory credit for each day prior to conviction discretionary against fine.
· Increases penalties for DWLS if revocation from DUI or refusal, 6 months jail/fine of $2000.00 (No deferrals or suspension of penalties) (Vehicle shall be impounded/possess CDL-it will be suspended.
· Allows operation of quadricycle without motorcycle endorsement
· Disposal of abandoned mobile homes on rental property
· Increases fine and incarceration of DUI’s where passenger(s) under 16.
· Surcharges must be imposed on municipal criminal offenders.
· Victims Adovcacy surcharges increases from $25.00 to $50.00.
· Revises MIP penalties for 18-21 year olds
1) $100-$300 fine, 20 hr community
service, alcohol class
2) $200-$600 fine, 40 hr community
service, alcohol class
3) $300-$900 fine, 60 hr community
service, alcohol class & 6 months jail.
· Drivers license will reflect interlock, conditions, etc..
· Court may issue a standing no contact order and direct law enforcement to serve on defendants charged with Partner/Family Member Assault to be issued at the time defendant is charged. Effective 72 hours or defendants 1st court application.
· Expands the offense of assault with bodily fluids—changes mental state element– extends to emergency responders, health care providers.
· Creates misdemeanor money laundering ring statute for the forfeiture and sale of property used in the commission of an offense.
The judges and Court Clerks will be attending training in Billings October 2-7.
